Hi. I have not posted responses here for some time, particularly because it has been a source of misinformation in the past. If you want to know the facts please contact us directly. We are working on all clients behalf to deliver a satisfactory outcome for all, however people like "Bob the builder" (whom some of you will know as Roy),have made this job much harder by spreading rumours and misinformation. Roy has infact made a lot of money out of his clients on this, much more that you might expect (up to 35% of his clients payments have gone to him!!),based on an agreement between him and a former managing director that had to be dismissed for misconduct from an associated company of ours. He then asks clients to part with more money to fund a legal fight with us because we didnt like his actions and didnt pay his last bill. We offered to meet his clients face to face, he said no, he wanted his payments first ie he puts his interests first rather than those of his clients. This is always the concern about these forums, people often have a hidden agenda. You know who we are, we will continue to fight for our clients best interests, it is regretable that matters have taken so long.

I have been in contact with Mr Bob The Builder or Mr. Roy like you explained, through this forum and the only thing that he said was that many clients bought land from Kapital International without licenses to be in place. In the near future that proved to be a big reality. So I suppose your clients bought useless land. So, what are these rumours and misinformation you state? I see this like a big truth. What actions Kapital is undertaking to solve this problem. Moreover I have been also informed that there are communication problems such as promised newsletters that never published etc. I can say that this case is very interesting and media should be informed accordingly.

I would comment; the majority of people registered on this forum use pseudo names not to be identified. I appreciate Kapital seem to have their own rules i.e. registered using more than one pseudo name. We know this as Kapital have been previously reprimanded by this forum, answering their own questions etc (would this be your hidden agenda?). I also consider your personal comments amazing as we don’t know who you are. How can people take you seriously and how do people respond to what could be construed slanderous accusations by you. You have assumed and stated to the forum Bob the builder is Roy, as you are Kapital I have to assume you are Keith.

Bob the builder is on this forum as a disatisfied buyer of land from Kapital. Not as a company selling land as you assume. Any legal costs that you mention have been between a number of disatified buyer s who have over a 16 month period become dispondent with Kapital‘s lack of communication and promises that never materialisize, especilaly when Kapital stated in November 2010 we would have licenses in place in 4 months then it changed to 4 to 6 months. This was the reason why this group decided to pay an independent lawyer in Brazil and have their team conduct their own professional topographical report and guess what, we had the disappointing results in under 4 weeks. The group is confused Kapital did not instruct a legal team to have their own topographical report on Praia Luxuosa and communicate the results and intentions to all their clients?

You did ask Roy not to confuse buyers and agents issues and not to include both in the same communication. Roy states he did adhere to your request. However, you persist in the opposite, having your own rules and agenda.

When client questions that were asked and were not fully answered. Keith was requested to answer direct questions with direct answer. This never materialised and when stating he was prepared to meet the clients, I stated why you don’t answer the questions first. I did not receive a reply on that one. I would comment, meetings have previously been organised with Keith. However, they never took place. People who purchased plots of land from Kapital would become clients of Kapital. Therefore, Kapital can communicate by email, telephone, Skype, travel to meet clients, invite clients to their office.

I believe Roy is taking legal action against Kapital, although you know this as both sides should have had their legal representatives in Court yesterday. However, It is alleged Kapital’s Solicitor withdrew their services and Kapital had to represent themselves and as previous, requested for more time as Kapital will now have to appoint another Solicitor. The result being another rearranged date. Just to put on record Roy has confirmed any legal funding will be paid by himself and not how you have stated on this forum.
With regards to your comments relating to non payment of invoices, your gross miscalculation of commission and contract issues, I don’t think it would be pertinent to comment as this will hopefully take place in court.

I would comment on plots marketed by Roy and until Kapital increased prices, his plots were between 10% and 20% discounted. Therefore, cheaper than buying from Kapital direct.

Finally, you mention a former managing director that had to be dismissed for misconduct from an associated company of ours. Who are you referring, would this be Mr. Keith? (Not to be confused with the Keith this message is addressed).

Finishing on a positive note; we all look forward to any positive news you might have.

I also have not posted here before but could not help picking up on a comment about Mr Keith on the Kapital International post when he referred to "a former managing director that had to be dismissed for misconduct from an associated company of ours." I have had, and still have, numerous business dealings with Mr Keith over many years an and can assure you that he is amongst the most honest and forthright people in the industry. I also know, for the record, that he was not "dismissed for misconduct, and it baffles me why Mr Punler would make such a statement.

I have had, and still have, numerous business dealings with Mr Keith over many years an and can assure you that he is amongst the most honest and forthright people in the industry. I also know, for the record, that he was not "dismissed for misconduct, and it baffles me why Mr Punler would make such a statement.
With all the information given in these over hundred messages it shouldn't be too difficult to locate this 'gentleman'.
Alternatively, make it a legal case in Brazil and in the UK.
I'm sure they have something that you could try and confiscate?!
Did you talk to AIPP, the various Chambers of Commerce, British Embassy in Brazil and the Brazilian Embassy in the UK?

It is sad that this most of these investment SCAMS in the North-East of Brazil, especially Ceará, RN and Paraíba, are BRITISH misMANAGED.
New ones are popping up on a regular basis and I'm sure these are not the last ones we are going to see here.
Brazilian laws are apparently attracting the worst of Europe!

I also have purchased a number of plots on the Praia Luxuosa development in Flecheiras, and have been recieving scant emails from the office of Keith Punler stating that they have no licences to develop as promised, they have applied for another one and don't know when or if this licence will be granted. Now I am definitely taking legal action, just wanted to enquire with anyone who has done so already. I have visited this location in 2010 and it is at least 2 hours drive from Fortaleza, about 70-80 miles away and is in the middle of nowhere, with next to zero amenities near it and a very undeveloped small flavela type town.

I require advice as to whether to sue in the UK or brazilian courts or both? I have deeds and purchase contracts in english and brazilian and this land is supposed to be registered in Brazil legitimately. However, I am desperate to know if there is a group action being taken against Kapital and whether that was done in the UK, as Keith Punler is not responding when contact is attempted.

Would appreciate the feedback.

I think you should check out the status of Kapital International Investment Ltd with Company House. If you are owed money, you will need all the luck in the World.

Could you elaborate on that Bob? I am aware they are now callled Kapital Assets Ltd, as a UK company, and are still operating under Keith Punler with their sister company Kapital Nordeste in Brazil. May I ask did you successful recover funds from them in the UK via the UK courts?

Clearly there is a need for legal action on my part and would appreciate advice on the matter as Kapital and their subsidaries clearly have no intention to refund my investment without being ordered to do so. I would like to ask, are you a lawyer? Do you have any personal connection or experience with this firm? I would like you to contact me with details of your arrival in the UK so we could discuss this further.

I have found some people's previous comments on this forum on the subject to be useless and not clear why they made comments if they had no constructive input. However, I will be very interested to hear what you have to say in December.

Thanks for the reply Marcia. I am also considering legal action against Greenland Securities/ Steve Naish as I bought a plot in 2009 in 'Jardim Do Mar' near Jacuma. No development has been done and have not been able to contact Steve Naish despite several attempts for over two years. I am aware there are some lawyers leading a class action against Greenland, however I would like to discuss this element with you first also. I am familiar with Joao Pessoa having visited a few times. May I ask what firm you work for?

There are some government agency that could be helpful regarding your problems with this company and law firm.

You could contact Procon, that is a government agency that deal specifically with customer issues. This company which sold the property could receive a fine if they don't obey the Customer Law. However, this agency can not force them to refund your investments.

Regarding the law firm issues, the due agency to complain, if they are Brazilian, is the OAB (the Brazilian Bar Association).

But if they deny to refund the investments made or fees paid, it is necessary taking them to the court. Although could be expensive to do that, there are some ways that could save money, as the benefit of unpaid court costs and a flexible lawyer.

I have invested in some properties in Brazil, unfortunately as happen to you the company had not fulfilled the agreement and has not completed the development in the right time.
I and others hired a lawyer and filed lawsuits against them to be refunded about the investments made plus interests and torts. We are pretty confident as there is some nuances in Brazilian Law that are very helpful in this kind of case.
